When you provide your mobile phone number and consent to receive SMS messages through our website or during a call with our AI voice agent, we collect and store:
- Your mobile phone number in E.164 format
- The date and time of your consent
- The exact consent language you agreed to
- The method by which you opted in (web form, verbal consent during call, etc.)
- The restaurant associated with your consent
SMS consent data is stored separately in our sms_web_signups and sms_consent_audit tables and is never sold or shared with third parties for marketing purposes.

We use the information we collect to:
- Deliver the SMS notifications you requested (order confirmations, updates, reminders)
- Operate and improve our AI voice agent platform
- Process and fulfill orders placed through our system
- Respond to customer service inquiries
- Maintain TCPA-compliant records of SMS consent
- Send transactional emails and service-related communications
- Comply with legal obligations
We do not use your information to send unsolicited marketing messages, sell your data to third parties, or build advertising profiles.

- Restaurant partners: Order and customer data is shared with the specific restaurant you are ordering from in order to fulfill your order.
- Service providers: We use trusted third-party providers (Twilio for SMS delivery, Microsoft Azure for cloud infrastructure) under strict data processing agreements.
- Legal requirements: We may disclose information if required by law, court order, or to protect the rights and safety of RestroTalk, our users, or the public.
- Business transfers: In the event of a merger or acquisition, your information may be transferred as part of that transaction, subject to the same privacy protections.
5. Data Retention
We retain your personal information for as long as necessary to provide our services and comply with legal obligations:
- SMS consent records: Retained for a minimum of 4 years to comply with TCPA requirements, even after you opt out.
- Opt-out records: Retained indefinitely to ensure we honor your request to not receive messages.
- Call transcripts and order data: Retained for 2 years, then anonymized or deleted.
- Account data: Retained until account deletion is requested, then deleted within 30 days.
6. Your Rights & Choices
SMS Opt-Out
You may opt out of SMS messages at any time by replying STOP to any message. You will receive one final confirmation message, then no further messages. You can re-subscribe at any time by texting START or by visiting our SMS signup page.
Access & Deletion
You have the right to request access to the personal information we hold about you, request correction of inaccurate data, or request deletion of your data (subject to our legal retention requirements). To exercise these rights, email privacy@restrotalk.com.
California Residents (CCPA)
California residents have additional rights under the California Consumer Privacy Act, including the right to know, delete, and opt-out of the sale of personal information. We do not sell personal information. To submit a CCPA request, email privacy@restrotalk.com.
