By accessing or using RestroTalk's website, platform, or SMS messaging program, you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to these Terms, please do not use our services.
These Terms constitute a legally binding agreement between you and RestroTalk, Inc. ("RestroTalk," "we," "our," or "us"). We may update these Terms at any time. Continued use of our services after changes constitutes acceptance of the revised Terms.
2. Our Services
RestroTalk provides an AI-powered voice agent platform for restaurants, including:
- Automated voice call handling and order-taking via AI
- SMS order confirmations and status notifications
- Integration with point-of-sale (POS) systems
- Restaurant management dashboard and analytics
- Knowledge base and AI agent configuration tools
Our services are provided on an "as is" basis. We reserve the right to modify, suspend, or discontinue any part of our services at any time with reasonable notice.
3. SMS Messaging Terms

You may opt out of SMS messages at any time by replying STOP to any message. After opting out, you will receive one final confirmation message. You will not receive further messages unless you re-subscribe. To re-subscribe, text START to the number from which you received messages, or visit our SMS signup page.

Supported Carriers
Our SMS program is supported by major US wireless carriers including AT&T, Verizon, T-Mobile, Sprint, and others. Carrier support may vary.
No Purchase Necessary
Consent to receive SMS messages is not required as a condition of purchasing any product or service from RestroTalk or our restaurant partners.
4. Accounts & Registration
Restaurant operators must create an account to access RestroTalk's management platform. You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activity that occurs under your account
- Notifying us immediately of any unauthorized use of your account
- Ensuring all information you provide is accurate and current
You must be at least 18 years old and authorized to operate a business to create a restaurant account.
5. Acceptable Use
You agree not to use our services to:
- Send unsolicited commercial messages or spam
- Violate any applicable laws, including the Telephone Consumer Protection Act (TCPA) and CAN-SPAM Act
- Harass, threaten, or harm any person
- Transmit fraudulent, deceptive, or misleading content
- Attempt to gain unauthorized access to our systems
- Reverse engineer or copy our AI models or proprietary technology
- Use our services in any way that competes with RestroTalk without our express written consent
RestroTalk reserves the right to suspend or terminate accounts that violate these restrictions without notice.
6. Intellectual Property
RestroTalk and its licensors own all intellectual property rights in our platform, including software, AI models, designs, and content. Nothing in these Terms grants you any right to use our trademarks, logos, or brand names without prior written consent.
You retain ownership of content you provide to us (e.g., your menu, restaurant information). By providing this content, you grant RestroTalk a limited license to use it solely to deliver our services to you.
7. Payment & Billing
Restaurant operators agree to pay the subscription fees applicable to their chosen plan. Fees are:
- Billed monthly or annually, as selected at signup
- Non-refundable except as required by law or as stated in our refund policy
- Subject to change with 30 days' advance notice
Failure to pay may result in suspension or termination of your account. You are responsible for all taxes applicable to your use of our services.
8. Disclaimers
OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
We do not warrant that our services will be uninterrupted, error-free, or free of viruses. AI voice agents may make errors in understanding or processing orders — restaurant operators are responsible for reviewing and confirming orders in their POS systems.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, RESTROTALK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM YOUR USE OF OUR SERVICES.
Our total liability for any claim arising from these Terms or your use of our services shall not exceed the amount you paid to RestroTalk in the 12 months preceding the claim.
10. Termination
Either party may terminate the service relationship at any time. You may cancel your subscription through your account dashboard or by contacting us. We may terminate or suspend your account immediately for violation of these Terms.
Upon termination, your right to use our services ceases immediately. We will retain your data as required by law and our Privacy Policy.
11. Governing Law
These Terms are governed by the laws of the United States and the State of Delaware, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved through binding arbitration in accordance with the American Arbitration Association rules, except that either party may seek injunctive relief in a court of competent jurisdiction.
By using our services, you waive your right to participate in a class action lawsuit or class-wide arbitration against RestroTalk.
